Service Agreement

The Dental Mentor Service User Agreement is an important document that outlines the terms and conditions of using our services. It establishes the rules that all users must follow while engaging with our community of healthcare professionals. The agreement covers a range of topics, including privacy, intellectual property rights, and professional conduct. It also includes a list of “Dos and Don’ts” that specify what actions are allowed and prohibited on our services. We take these terms seriously and expect all users to do the same in order to maintain a safe and respectful environment for everyone. 1.1 Contract By using our Services, you agree to be bound by these terms, our Disclaimer, and our Privacy Policy. Our Privacy Policy outlines how we collect, use, share, and store your personal information.

When you click “Join Now,” “Submit,” “Register,” “Apply Now,” or similar, or when you register, access, or use our services (as described below), you agree to enter into a legally binding contract with Dental Mentor, even if you are using our Services on behalf of a company, school, or university. If you do not agree to this contract (“Contract” or “User Agreement”), please do not click “Join Now” (or similar) and do not access or use any of our Services. You may terminate this contract at any time by closing your account and discontinuing your use of our Services. To close your account, please use our online contact form and request that your account be officially closed.

This Contract applies to all of our Services, including dentalmentor.org, dentalmentor.co.uk, Dental Mentor online resources, and other Dental Mentor-related sites, apps, communications, and offsite data collection for those Services. Registered users are considered “Members” and unregistered users are “Visitors.” This Contract applies to both Members and Visitors.

You are entering into this Contract with Dental Mentor, also referred to as “we” and “us.”

For those residing in the “Designated Countries” (EU, EEA, Switzerland), Dental Mentor Ltd. is the controller of your personal data provided to, collected by, or processed in connection with our Services. If you reside outside of the “Designated Countries”, Dental Mentor Ltd. is still the controller of your personal data.

As a Visitor or Member of our Services, the collection, use, and sharing of your personal data is subject to this Privacy Policy (which includes our Cookie Policy and other referenced documents) and updates.

When you register for the Dental Mentor Service or become a registered user on dentalmentor.org, you become a Member. If you choose not to register, you may still access certain features as a Visitor.

We may modify this Contract, our Privacy Policy, and our Cookie Policy from time to time. If you object to any changes, you may close your account by using or online contact form. Your continued use of our Services after we publish changes to these terms means that you are consenting to the updated terms.

To use our Services, you must be at least 13 years old (or the Minimum Age required by law for lawful processing of your personal data). You also agree to only have one Dental Mentor account in your real name and not to use the Services if you are already restricted by Dental Mentor. Creating an account with false information, including accounts registered on behalf of others or persons under 13, violates our terms.

As a member and account holder, you are responsible for maintaining the security and confidentiality of your account. This includes choosing a strong password, not sharing your account with anyone else, and following both our rules and the law. Additionally, you must comply with our list of Dos and Don’ts and Professional Community Policies. You are solely responsible for any actions taken through your account unless you report any misuse or close the account.

If the Services were purchased by another party for you to use, they have the right to control access to and receive reports on your use of the paid Service. However, they do not have rights to your personal account.

By purchasing our paid Services, you agree to pay the applicable fees and taxes, and to our refund policy specific to the paid Services. Failure to pay these fees will result in the termination of your paid Services. Please note:

Foreign exchange fees or differences in prices based on location may apply. We may store and continue billing your payment method even after it has expired, to avoid interruptions in your Services and to use for other Services you may buy. If you purchase a subscription, your payment method will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, cancel before the renewal date. To cancel your subscription, please use our online contact form and request to cancel your subscription in writing. All purchases of Services are subject to Dental Mentor’s refund policy. We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase. You can request a copy of your invoice by using our online contact form and putting your request in writing to us.

We may provide notices and messages to you through our websites, apps, and contact information. It is your responsibility to keep your contact information up to date.

We may provide notices and messages to you within the Service or sent to the contact information you provided us (e.g., email, mobile number, physical address). Please make sure to keep your contact information up to date.

Please be aware that when you share information on our Services, others can see, copy and use that information. However, we provide settings that allow you to choose who can see your content or information.

We are not obligated to publish any information or content on our Service, and we reserve the right to remove it in our sole discretion, with or without notice.

You own all the content, feedback, and personal information you provide to Dental Mentor, but you grant us a non-exclusive license to use it. We respect your choices about who gets to see your information and content and how it can be used for ads. However, we don’t post third-party ads on the Dental Mentor website unless they are Dental Mentor Partners involved in shared delivery of Dental Mentor services.

As the owner of the content and information you submit or post to the Services, you grant Dental Mentor and our affiliates a limited, non-exclusive license to use, copy, modify, distribute, publish, and process the information and content you provide through our Services and the services of others. We don’t require any further consent, notice, and/or compensation from you or others. However, you can revoke this license for specific content by deleting it from the Services or closing your account, except when others have already shared, copied, re-shared or stored the content or when we need to keep it for a reasonable amount of time to remove it from backup and other systems.

We won’t include your content in ads for third-party products and services without your separate consent. However, we have the right to serve ads near your content and information, and your social actions may be visible and included with ads, as noted in the Privacy Policy.

We will obtain your consent if we want to give others the right to publish your content beyond the Services. However, if you choose to share your post as “public,” we will enable a feature that allows other Members to embed that public post onto third-party services, and we enable search engines to make that public content findable through their services.

We may edit and make format changes to your content, such as translating it, modifying its size, layout or file type, or removing metadata. However, we won’t modify the meaning of your expression.

Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others, including under the terms of a Creative Commons license.

If your content includes personal data, it is subject to our Privacy Policy. We may access, store, process, and use any information and personal data that you provide in accordance with the Privacy Policy and your choices.

By submitting feedback or suggestions regarding our Services to Dental Mentor, you agree that we can use and share (but don’t have to) such feedback for any purpose without compensation to you.

You promise to only provide information and content that you have the right to share, and that your Dental Mentor profile will be truthful. You agree to only provide content or information that doesn’t violate the law or anyone’s rights, including intellectual property rights.

Dental Mentor may be required by law to remove certain information or content in certain countries.

We may change, suspend, or end any Service, or change and modify prices prospectively at our discretion. These changes may be effective upon notice provided to you, to the extent allowed by law.

We may change or discontinue any of our Services, and we don’t promise to store or keep showing any information and content that you’ve posted. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.

Your use of others’ content and information posted on our Services is at your own risk.

Third-party products and services may be offered through our Services, and we aren’t responsible for those activities.

By using the Services, you may come across content or information that might be inaccurate, incomplete,

Dental Mentor reserves the right to limit your use of our Services, including your ability to contact other Members and the number of your connections. We may also restrict, suspend, or terminate your account if we believe you are in violation of this Contract or any law or if you misuse the Services (e.g., by violating the Dos and Don’ts or Professional Community Policies).

We want to inform you of our intellectual property rights.

Dental Mentor holds all of its intellectual property rights in the Services. Your use of the Services does not grant you any ownership of our Services or the content or information available through our Services. Any trademarks and logos used in connection with the Services belong to their respective owners. Dental Mentor trademarks, service marks, graphics, and logos used for our Services are trademarks or registered trademarks of Dental Mentor.

We use data and information about you to make recommendations to you and others.

We use your data and information, as well as that of other Members, to suggest Services, content, and features that may be relevant to you. By keeping your profile up-to-date and accurate, we can make more precise and relevant recommendations for you. For instance, we may suggest volunteering, publishing, useful books or electronic resources, relevant events, and more.

We provide this disclaimer to relieve ourselves of legal liability for the quality, safety, or reliability of our Services.

DENTAL MENTOR AND ITS AFFILIATES (AND THOSE THAT Dental MENTOR WORKS WITH TO PROVIDE THE SERVICES) DISCLAIM ALL IMPLIED WARRANTIES AND REPRESENTATIONS, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NONINFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS. WE PROVIDE THE SERVICE (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS.

SOME LAWS MAY NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OR ALL OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.

We limit our legal liability to you as described below.

DENTAL MENTOR AND ITS AFFILIATES (AND THOSE THAT DENTAL MENTOR WORKS WITH TO PROVIDE THE SERVICES) SHALL NOT BE LIABLE TO YOU OR OTHERS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, REPUTATION, PROFITS, OR REVENUES RELATED TO THE SERVICES (E.G., OFFENSIVE OR DEFAMATORY STATEMENTS, DOWNTIME, OR LOSS, USE OF, OR CHANGES TO, YOUR INFORMATION OR CONTENT). WE ARE NOT RESPONSIBLE FOR ANY CHANGES TO VENUES OR TIMINGS OF EVENTS, INCLUDING CANCELLATION OR RESCHEDULING OF EVENTS. ADDITIONAL COSTS FOR TRAVEL AND ACCOMMODATION CANNOT BE COMPENSATED, AND WE RESERVE THE RIGHT TO AMEND EVENTS AS WE DEEM APPROPRIATE.

THIS LIMITATION OF LIABILITY IS PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND DENTAL MENTOR AND APPLIES TO ALL CLAIMS OF LIABILITY, INCLUDING WARRANTY, TORT, NEGLIGENCE, CONTRACT, AND LAW, EVEN IF WE OR OUR AFFILIATES HAVE BEEN TOLD OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY SHALL APPLY EVEN IF THESE REMEDIES FAIL THEIR ESSENTIAL PURPOSE.

SOME LAWS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

Either party may terminate this Contract with notice to the other. Upon termination, you will no longer have access to the Services. However, the following provisions will survive termination:

  • Our rights to use and disclose your feedback;
  • Members’ and/or visitors’ rights to further re-share content and information you shared through the Service to the extent copied or re-shared prior to termination;
  • Sections 4, 6, 7, and 8.2 of this Contract; and
  • Any amounts owed by either party prior to termination.

In the unlikely event of a legal dispute, any such dispute shall be resolved in the UK courts using UK law. For those living in the Designated Country, claims and disputes can only be litigated in the UK courts, while for those outside the Designated Country, all claims and disputes can only be litigated in the UK courts.

f any part of this Contract is found unenforceable, the court should modify the terms to make it enforceable while still achieving its intent. If that is not possible, the court may remove the unenforceable part and still enforce the rest of the Contract.

The English language version of this Contract is binding, and translations are for convenience only. This Contract is the only agreement between us regarding the Services and supersedes all prior agreements.

If Dental Mentor does not enforce a breach of this Contract, it does not mean that Dental Mentor has waived its right to enforce this Contract. This Contract may not be assigned or transferred without our consent, but we may assign this Contract to our affiliates or a party that buys it. There are no third-party beneficiaries to this Contract.

Dos

Dental Mentor is a community of healthcare professionals. To ensure a professional and respectful environment, we ask that you adhere to the following list of “Dos and Don’ts” and our Professional Community Policies when using our Services.

As a user, you agree to:

  • Comply with all applicable laws, including privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements.
  • Provide accurate information to us and keep it updated.
  • Use your real name on your profile.
  • Use the Services in a professional manner.

Don’ts

As a user, you agree not to:

  • Create a false identity, misrepresent your identity, create a profile for anyone other than yourself, or attempt to use another’s account.
  • Use software, devices, scripts, robots, or any other means to scrape or copy profiles and other data from the Services.
  • Override security features or bypass access controls or use limits of the Service.
  • Copy, use, disclose or distribute any information obtained from the Services without the consent of Dental Mentor.
  • Disclose confidential information of others, including your employer, without their consent.
  • Violate the intellectual property rights of others or of Dental Mentor, including copyrights, patents, trademarks, trade secrets, or other proprietary rights.
  • Post anything that contains harmful code like software viruses or worms.
  • Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source.
  • Imply or state that you are affiliated with or endorsed by Dental Mentor without our express consent.
  • Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same without Dental Mentor’s consent.
  • Deep-link to our Services for any purpose other than to promote your profile or a Group on our Services without Dental Mentor’s consent.
  • Use bots or other automated methods to access the Services, add or download contacts, or send or redirect messages.
  • Monitor the Services’ availability, performance or functionality for any competitive purpose.
  • Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services.
  • Overlay or otherwise modify the Services or their appearance.
  • Interfere with the operation of, or place an unreasonable load on, the Services.
  • Violate the Professional Community Policies or any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.

We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties. If you would like ot submit a complaint, please put this in writing using our online contact form.

If you need to make a request for refunds, cancellations, complaints, freedom of information requests, or have any other queries about how Dental Mentor uses your personal data, please use our online contact form. We will respond to your request within 28 days in writing.
